DACA Renewal, San Rafael
What is DACA?
Immigrants come to San Rafael, Richmond, San Francisco, and the entire Bay area all the time. Often families arrive with young children, who are left without the proper immigration papers when they grow up. There is a law that exists to help those children get protection from being deported, called DACA.
DACA stands for Deferred Action for Childhood Arrivals. The purpose of DACA is to protect eligible immigrants against deportation because they came to the United States when they were children.
When DACA is approved, the youth will be granted temporary permission to stay in the United States, called “deferred action’. They will also be granted permission to work, and they will receive a work permit.
You can apply for DACA, if you are at least 15 years of age unless the applicant is in removal proceedings (deportation process). In this case, the applicant can apply for DACA below the age of 15.
When you apply for DACA, the processing time can take longer than the stated 120 days. In our experience at Bueno Law office in San Rafael, the entire processing time takes more like anywhere from 6 to 12 months on average.
We offer help filing your entire DACA application package, where we fill out form I-821D so that you don’t need to worry about if everything was filled out correctly.
Hiring a professional lawyer is a good idea if you are filing for DACA because it increases your chances of getting your case approved.
Once a youngster receives DACA, it can be renewed. When your DACA expires, it’s best to seek legal advice since the DACA laws are subject to change. People already in the DACA program can continue to renew, although since December 7th, 2020, a few changes have been made. For more information visit USCIS website.
They have extended one-year grants of deferred action under DACA and employment authorization to two years. This is, of course, great news.
DACA renewals, however, aren’t free. The DACA renewal fee for 2021 is $495. You must pay this amount to the U.S. Department of Homeland Security. You can pay with check (include your name!) or money order.
Always renew your DACA on time, to avoid immigration problems including deportation. It's best to seek help from a professional immigration attorney, to help you with your DACA renewal.
