DACA Work Permit Renewal, San Rafael

DACA stands for Deferred Action for Childhood Arrivals (DACA).
This immigration law protects eligible undocumented immigrants who came to the United States with their parents when they were children.

If a person is protected under DACA, they get employment authorization, known as a work permit, and protected from being deported.

Having a DACA work permit opens the doors to new opportunities that one might do not have before. The person with a DACA work permit can now apply for jobs and legally work in the United States.
When applying for a job, always be aware of your employment rights.
DACA needs to be renewed every two years.
It’s essential to be in order with all your papers to avoid immigration problems, denial of your DACA extension or even removal/ deportation.
When you receive your DACA protection, it’s up to you to file for renewal.

The USCIS recommends filing for DACA renewal three to four months from when your DACA expires, but they will accept request from up to one year in advance. With this renewal, your work permit will renew too.
We recommend filing for renewal as early as possible because early is on time! We see many delays at immigration offices, and you want to be sure that you stay in order with the paperwork that will allow you to continue working and residing in the country.

However, for whatever reason, you happen not to have filed within these periods, there is still hope, but you need to speak to an immigration attorney.
When your DACA and work permits expire, your immigration status will change to unlawful presence. At this time, it is necessary to speak with a lawyer to go over your legal options to continue working and residing (legally) in the United States.
