VAWA, San Rafael, Ca

VAWA, or Violence Against Woman Act, was introduced on September 13th, 1994, by President Bill Clinton.
The Violence Against Woman bill provides more accessible federal resources to combat violence of all kinds,
including domestic violence against women, dating violence, stalking, and sexual assault crimes.
 
The violence against woman act of 1994 helped many noncitizens women who were spouses of U.S. citizens or permanent residents gain special immigration status. This special route to immigration was available to woman only in the case of abuse of some kind. Also, children and parents may be eligible.
 
Who is covered under VAWA?
Non-immigrant spouses of abusive U.S. citizens or lawful permanent residents. Divorced spouses may petition themselves if the divorce was related to the abuse and if the application is filed within two years of the marriage termination.
Also, children of an abusive citizen or lawful permanent resident parents can file for VAWA. They have to file before they turn twenty-five. 
 
A VAWA victim can be eligible for cancellation of removal if:
  • There is proof that there was abuse by the U.S. spouse or permanent resident.
  • The victim has been physically present in the United States for three years.
  • The victim has a good moral character.
 
VAWA and U visa, what is the difference?
U visa is for victims of serious crimes, and VAWA is for abused spouses, certain parents, and children of U.S. citizens or permanent residents. Another difference between the two is that there are no limits on VAWA self petitions. On a U visa, there is a limit of 10,000 visas given out per year. So U visa applicants may have to wait until the next year for their application to be processed.
 
The process of VAWA is a much faster path to immigration. In most cases, you can file for adjustment of status at the same time when you submit your petition. The waiting process for VAWA will take in between a few months to two years.
Another good thing about filing for VAWA is that it is free of cost.
U visa cases take much longer. After the petition is approved, you might be placed on a waiting list for several years, which they call ‘deferred action.’
After finally getting the U visa, you will have to wait for another three years to apply for a green card. And then this process may take another few years.
So the entire path to immigration through a U visa can be extremely long and tricky. If you can apply for VAWA, you definitely should.
 
When you file for VAWA, you may be eligible for VAWA housing. The federal government subsidizes based on stalking, domestic, dating, and sexual violence.
 
In 2018 the Violence Against Woman Act expired due to a government shutdown. It was reauthorized on January 25th, 2019 but expired again on February 15, 2019.
